5DE, LLC d/b/a ClientSide (“ClientSide”, “We“, “Us” or “Our”) respect Your privacy and are committed to protecting it through Our compliance with this privacy policy (the “Privacy Policy”).  This Privacy Policy describes the types of information We may collect from You or that You may provide when You visit the website www.goclientside.com or www.firmlogin.com, access or use Our software, together with any associated services, features, functionality, content, applications, or products offered by ClientSide (collectively, the “Services”), and Our practices for collecting, using, maintaining, protecting and disclosing that information.  The ClientSide Terms of Service (the “Terms of Service” or the “Agreement”) are incorporated herein by reference, and can be found here: https://www.goclientside.com/terms-of-service.

CHANGES TO THIS PRIVACY POLICY

We reserve the exclusive right to make changes to this Privacy Policy from time to time.  Your continued access to and use of Our Software and/or Services constitutes Your agreement to be bound by, and Your acceptance of, the Privacy Policy terms posted at such time.  You acknowledge and agree that You accept this Privacy Policy (and any amendments thereto) each time You sign into Your account, access, or use the Software and/or Services.  Therefore, we encourage You to review this Privacy Policy regularly.

If, within thirty (30) days of Us posting changes or amendments to this Privacy Policy, You decide that You do not agree to the updated terms, You may withdraw Your acceptance to the amended terms by providing us with Notice of Your withdrawal (as set forth in Section 13 of the Terms of Service).  Upon providing Us with the Notice of your acceptance withdrawal, You are no longer authorized to access or use the Software or Services, and You must not do so.

1. YOUR INFORMATION

We may collect and store the following information when You use Our Software or Services:

a) Information You Provide. When You register an account, request or access a Free Trial, purchase a Subscription, or use or access the Software and/or Services, We collect some personal information, such as Your name, contact information, mailing address, telephone number and email address. If You are purchasing, using or accessing the Software on behalf of an entity, then We may also collect the business name, address, contact information, industry, and Your position or job title. When You invite third parties to use or access the Software, or if You send information through or via the Software to others, We may collect and store those third parties’ contact information that You provide to us (all of the foregoing personally identifiable information is “Personal Information”).

b) Automatically Collected Information. We automatically receive certain types of information when You access, use or interact with the Software, including any associated services, and when You send information to third parties or request information from third parties. For example, it is standard for Your web browser to automatically send information to every web site You visit, including Ours. That information includes Your computer’s Internet Protocol (IP) address, access times, Your browser type and language, and referring web site addresses. We may also collect information about the type of operating system You use, Your account activity, and files and pages accessed or used by You. Furthermore, We collect and store activity information that is generated when the Software is accessed or used by You or by third parties with whom You interact through or via the Software. For example, if You send an electronic document for signature through the Software, the IP addresses of the parties who send, receive, access and sign the document are automatically recorded, along with the dates and times of those actions.

c) Log Data. When You access or use the Software, We may automatically record information from the device You use to access and use the Software, its software, and Your activity using the Software. This may include the IP address, browser type, identification numbers associated with Your device, Your mobile carrier, date and time stamps associated with transactions, system configuration information, metadata concerning Your files, and other interactions with the Software.

d) Suppliers and Partners. We may use certain trusted third party companies and individuals to help Us provide, analyze, and improve the Software and Service (including but not limited to data storage, maintenance services, database management, web analytics, payment processing, and improvement of the Software features). These third parties may have access to You information only for purposes of performing these tasks on Our behalf and under obligations similar to those in this Privacy Policy.

2. HOW WE USE YOUR INFORMATION

a) It is Our policy to keep private all of the Personal Information You submit to Us.

b) We do NOT sell, rent or provide access to Our mailing or email lists to any third party.

c) We use information that We collect about You or that You provide to Us, including any Personal Information ONLY:

i.  To make Our Software and Services accessible, available and usable to You;

ii.  To fulfill Our obligations under Our agreements with You;

iii.  To provide You with information, products or Software and/or Services that You request from Us;

iv.  To fulfill any other purpose for which You provide it;

v.  To provide You with notices about Your purchases and subscriptions, including expiration and renewal notices;

vi.  To carry out Our obligations and enforce Our rights arising from any contracts entered into between You and Us, including for billing and collection;

vii.  To notify You about changes to Our Software or any products or services We offer or provide though it;

viii.  To allow You to participate in interactive features on Our Software and Services;

ix.  For any other purpose with Your consent; and

x.  We may also use Your information to contact You about Our own additional products and Services that may be of interest to You.

3. DISCLOSURE OF YOUR INFORMATION

We may disclose Your Personal Information for the following reasons and purposes:

a) If We believe disclosure is necessary or appropriate to protect the rights, property, or safety of the ClientSide, Our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction; or

b) If We believe it to be necessary or appropriate to disclose it in order to: (1) comply with a law, regulation or compulsory legal request; (2) respond to requests from public and government authorities; (3) protect Our rights and property; (4) allow us to pursue available remedies or limit the damages that We may sustain.

4. ACCESSING AND CORRECTING YOUR INFORMATION

a) You can review and change Your information, including Your Personal Information, by sending Us an e-mail at [email protected]to request access to, correct or delete any Personal Information that You have provided to Us.

b) If You no longer desire to use the Software or Services You may send us an email to request a deletion of Your account at [email protected]In some cases We may retain copies of Your information if required by legal requirements or court order.

5. DATA SECURITY

a) We have implemented measures designed to secure Your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure.

b) The safety and security of Your information also depends on You. Where We have given You (or where You have chosen) a password for access to certain parts of Our Software, You are responsible for keeping this password confidential. We ask You not to share Your password with anyone.

c) Unfortunately, the transmission of information via the internet is not completely secure. Although We do Our best to protect Your Personal Information, We cannot guarantee the complete security of Your Personal Information transmitted to Our Software. Any transmission of Personal Information is at Your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Software.

d) Any documents, information or data that You send to others via or through the use of the Software is transmitted via an email link. Just as You may send an email with sensitive documents or information, the Software sends an email with a sensitive link on Your behalf through which the documents or information may be accessed. If You address and send the email containing the sensitive link to the wrong person or email account, or if Your email with the sensitive link is forwarded by Your intended recipient, the link (and the corresponding documents or information) may be accessed by those subsequent recipients.

6. NOTIFICATION OF CHANGES TO OUR PRIVACY POLICY

It is Our policy to post any changes We make to Our privacy policy on this page. If We make material changes to how We treat Our users’ Personal Information, We will notify You by e-mail to the e-mail address specified in Your account and/or through a notice on Your Software account home page. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring We have an up-to-date active and deliverable e-mail address for You, and for periodically visiting Our Software and this privacy policy to check for any changes.
